The staff member of the BAMF decides the outcome of the application and might put the asylum seeker under protection according to the four different protection status (they will be discussed in the following) 1. Click on the following tabs to get to know the protection status:

Refugee protection status

The applicant will be put under the refugee protection status, if he/she can’t s life in their home country because of the political/legal situation, since the government can’t guarantee the persons safety or the government itself is the one endangering the asylum seekers life/well-being.

The main reasons for prosecution are:

  • Sex and sexual orientation
  • Politics
  • Nationality
  • Religion
  • Racism

Prosecution is defined as:

  • Violence (physical and psychological)
  • Institutional prosecution
  • Disproportionate punishments
Qualification of political asylum

A qualification of political asylum is issued when people are prosecuted in their home country because of political reasons. It is not issued for people from the “sichere Drittstaaten” (e.g. countries of the EU). If on the way to Germany one of the “sichere Drittstaaten” was transited, one can not apply for a qualification of political asylum. The only possible way to enter Germany in order to apply for the qualification of political asylum would be via airplane or by boat.

Subsidiary protection

A refugee is put under subsidiary protection if one can be sure that he/she will be treated contrary to the human rights in their home country. The subsidiary protection status is issued for a year and can be renewed. From five years of living under subsidiary protection on the refugee can apply for an unlimited residence permit.

Prohibition of Deportation

A prohibition of deportation can be issued when none of the above case can be applied but refugee is nonetheless at danger of violence, losing their freedom, death etc. One of the main reasons for this are illnesses that are not /cannot be treated adequately in the home country.

Under this protections status the refugee is tethered to the place of residence and is subjected to strict legal obligations.
